Certificate of Need Standards and Criteria

A Certificate of Need (CON) is a permit for the establishment or modification of a health care institution, facility, or service at a designated location. Tennessee's CON program seeks to improve access, quality, and cost savings through orderly growth management of the state's health care system. The agency that uses the standards and criteria to decide whether to grant a CON is the Health Services and Development Agency (HSDA). The Division of Health Planning is in charge of updating the standards and criteria for granting a CON.

  

A CON is required to establish any of the following specific services and facilities:

Ambulatory Surgical Treatment Center

Discontinuance of Obstetrical Services

Nursing Home

Long Term Care Hospital Beds

Intermediate Care Facilities for the Mentally Retarded

Construction, Renovation, Expansion  or Replacement of Health Care Institutions

Acute Care Bed

Psychiatric Inpatient

Comprehensive Inpatient Rehabilitation

Swing Bed

Air Ambulance

Mental Health Residential Treatment

Neonatal Nursery

Alcohol and Drug Abuse Residential Treatment

Burn Units

Non-Residential Methadone Treatment

Positron Emission Tomography

Lithotripsy Services (ECSWL)

Magnetic Resonance Imaging

Megavoltage Radiation Therapy

Home Health Services

Residential Hospice Services

Hospice Services

Open Heart Surgery

Cardiac Catheterization

Outpatient Diagnostic Centers

Birthing Centers

 

  

In addition, a Certificate of Need is required for hospitals making facility expansions that exceed $5,000,000, non-hospitals making facility expansions that exceed $2,000,000, or the acquisition of any piece of medical equipment that exceeds $2,000,000. In some cases the transfer of beds and/or relocation of an existing service require a CON.
