TN Department of Labor and Workforce Development focuses on tax and insurance fraud in the construction industry

The department is taking new measures to ensure employers in the construction industry are protecting workers who are injured on the job or need unemployment benefits. Legislation that became effective July 1, 2013, gives the department the authority to issue civil penalties against construction service providers who have avoided workers’ compensation and unemployment insurance tax premiums.  The department will also refer cases involving business operations that are in violation of the law to the Tennessee Bureau of Investigation or the appropriate District Attorney General for criminal investigation and prosecution.The department will investigate employers who fraudulently misclassify employees as independent contractors, under-report the number of employees, under-report the amount of payroll, misrepresent the type of work performed, or make unlawful workers’ compensation deductions from employees’ salaries or wages. Employers who pay workers “off the books” or in cash often do so in order to avoid proper classification of their workers. The department will obtain Fraud Detection Software to assist in identifying potential suspects.

3rd quarter 2013 Premium and Wage Reports due October 31s

File quickly and accurately through TNPAWS

The Tennessee Premium and Wage Reporting System (TNPAWS) is our preferred method of filing the quarterly Premium and Wage Reports. The TNPAWS web site is located at and may be used by any active employer account. Users must have the department assigned Access Code to log into TNPAWS. The Access Code appears on the reporting forms and reminders we mail each quarter. If users cannot locate the Access Code, it may be retrieved from the web site.  
Every quarter, we have employers submit incorrect reports. Please verify the figures you enter for accuracy before filing the report. Once a report is filed and assigned a confirmation number, any adjustment must be communicated on paper which creates additional work for you and the department. After filing, employers can pay any amount owed by selecting the “Pay Online” button and entering their banking information. Using TNPAWS to file and pay the quarterly reports will save you money by eliminating the cost of postage.

Remember to file an accurate report to save time, file before the due date to avoid penalty charges, and pay on time to avoid interest charges. Thank you for using TNPAWS.

Workforce board members selected from
local communities

Fifteen new members and one reappointed member join the State Workforce Development Board, the body charged with advising the governor on matters of workforce development strategy for the state. The 36-member board includes representatives from business, state and local government, education, organized labor, community-based organizations, and the general public.




Employer support of hiring initiative
at all-time high

The turnout for the second year of Paychecks for Patriots topped that of last year with 249 employers representing 161 businesses. The hiring fair for veterans took place in 13 locations across the state on October 17, 2013.

Paychecks for Patriots featured many employers who took part last year and who, seeing the value, returned this year. The department added new employers as well.

Dollar General was again the lead sponsor of Paychecks for Patriots, in partnership with other private businesses, the TN Department of Labor and additional government agencies, and Employer Support of the Guard and Reserve.

Employer survey results last issue

In the department's survey last month, we asked employers about skills gaps in their hiring. More than 600 responded, and 85 percent of those said yes, it is hard to find employees with the skills they need.
