CMS Announces New Flexibility Rule Concerning 2014 Attestations

On August 29th, CMS announced a new rule extending flexibility to providers participating in the EHR Incentive Program. Effective October 1, 2014, for Program Year 2014, providers may now use EHRs that have been certified under the:

  • 2011 Edition;
  • Combination of 2011 and 2014 Editions (sometimes referred to as the 2013 Hybrid); or
  • 2014 Edition.

The information provided on this web site focuses on the TennCare Medicaid EHR Provider Incentive Payment Program. Eligible Professionals (EPs) must choose between participating in either the Medicare or the Medicaid EHR Incentive Program. Eligible Hospitals (EHs) can receive payments from both programs if they enroll as dual eligible hospitals. Medicaid-only and children’s hospitals will receive their EHR incentive payment from TennCare.

The CMS web site also has a lot of information and FAQs. CMS has the overall responsibility for the EHR Provider Incentive Payment Program, and the CMS web site is very general in nature. You are more likely to find the answers you need here on TennCare’s web site to participate in the TennCare Medicaid EHR Incentive Program. If you want information about attesting under the MediCARE incentive program, you will need to go to CMS.

Important Information Concerning MEDICARE Payment Adjustments

As part of the American Recovery and Reinvestment Act of 2009 (ARRA), Congress mandated payment adjustments to be applied to MEDICARE eligible professionals (EPs), eligible hospitals (EHs), and critical access hospitals (CAHs) which are not meaningful users of Certified Electronic Health Technology (CEHRT) under the Medicare OR Medicaid EHR Incentive Programs.  Payment adjustments will be applied beginning January 1, 2015 for MEDICARE EPs. EPs who first attest to Meaningful Use (MU) in 2014 must successfully achieve MU before October 1, 2014 to avoid MEDICARE payment adjustments. TennCare encourages these first year MU EPs to attest by August 1, 2014 to allow sufficient time to attest, and re-attest, within the attestation period if needed. However, TennCare will accept MU attestations for payment year 2014 until March 31, 2015. MediCAID EPs who can only participate in the MediCAID EHR Incentive Program and do not bill MEDICARE are not subject to these payment adjustments.

Payment adjustments will be applied beginning on October 1, 2014, for Medicare EHs. Payment adjustments for CAHs will be applied beginning with fiscal year 2015 cost reporting period.

EPs, EHs, and CAHs may apply to CMS for hardship exceptions to avoid the payment adjustments described above.

Current Payment Information

This table is updated weekly showing the number of EPs and EHs who are being paid and the amounts that have been paid through the TennCare EHR Provider Incentive Payment Program. TennCare EHR Newsletter

On a semi-regular basis (usually monthly), TennCare publishes an electronic newsletter to bring you the latest information about the EHR Provider Incentive Payment Program. We also copy and paste some newsletters from CMS that we feel may be of interest to you. With the upcoming changes to the program by the Stage 2 Final Rule, this newsletter is our best and quickest way to communicate with providers.
