Delivery Service License

Overview

A business whose primary source of revenue derives from food delivery may obtain a delivery service license to contract with certain off-premises retailers to deliver beverage alcohol to consumers. 

You can apply for this license using RLPS.

1. At least fifty percent (50%) of the delivery service's gross sales must come from the delivery of food products or prepared food. An initial application for a new delivery service license must contain a description of how the business will meet this requirement sufficient for the Commission to find an applicant is likely to meet this requirement before approval. 

2. Delivery services must have written contract between themselves and the beverage alcohol retailers for which they deliver. 

3. The delivery service must conduct, or have a third-party conduct, a criminal background check for each delivery employee or independent contractor.

4. The delivery service must file an annual report with the TABC stating the number of delivery drivers used during the prior year and must maintain records of background checks and drivers licenses for delivery employees or independent contractors. 

  1. Owners of a delivery service must not be convicted of a felApplicant must be 21 years or older.
  2.  Owners of a delivery service must be 21 years of age or older. 
  3.  A delivery service may not charge a fee based on a percentage of the sales of the beverage alcohol being delivered that exceeds ten percent (10%) of the price of the beverage alcohol in each order.
