Engineering Report

On December 30, 2019, new regulations became effective for landfill reporting of all active Class I and Class II permits in Tennessee.

Specifically, the requirement for "Remaining Life Surveys” found in Rule 0400-11-01-.04 has been replaced with new language requiring “Annual Engineering Reports”.  This requirement has been extended to Class II facilities, although these facilities will report every three years rather than annually.

Class 1 Facilities

The new amended annual reporting requirements consist of:

  • A current (one year old or less) topographic survey of the facility superimposed over approved permitted contours
  • Remaining life estimate and supporting calculations as previously required
  • A summary leachate generation report
  • A summary of permit modifications.

Class II Facilities

The triennial reporting requirements consist of:

  • A current (one year old or less) topographic survey of the facility superimposed over approved contours.
  • Remaining life calculations
  • A summary of permit modifications.

The language of this rule can be found starting at the bottom of page 74 of Rule 0400-11-01-.04.

Forms

Each report must be submitted with the following forms: Class I Annual Engineering Report Form (CN-1598) and Class II Triennial Engineering Report Form (CN-1597)Like the “Remaining Life Survey”, this information is due by May 1st of each year,  while Class II’s only report every third year beginning on May 1st, 2020.

We understand that normal disposal operations have been affected by COVID-19 nationwide. Since this is the first year of these requirements, requests for an extension to submit the report will be granted for 90 days.

Please submit written extension requests prior to the May 1, 2020 due date to Nick Lytle, and courtesy copy Craig Almanza.  It is the Division of Solid Waste Management’s goal to provide flexibility so as not to unduly burden facilities.
