The Division is getting ready to implement the new rules that were adopted as a result of a change in federal regulation. More information regarding this change and resources to assist you in maintaining compliance will be coming soon. The items that will be added to this page are not final versions of rules, forms or guidance and exist in draft form only. Also they are not printable. The sections below represent the main categories of items that needed to be modified due to the change in federal regulation.

Attention: Effective July 01, 2021

Yearly Tank Fees Have Been Suspended For Five Years, Fund Coverage Has Been Expanded And There Is Now A Scaled Deductible.

One important change is that effective on the next fee cycle of the new fiscal year (starting July 01, 2021) tank fees have been suspended for a period of five years. The Division has recently sent a letter to every active tank owner regarding this change. The Fee Suspension Letter should explain everything that a tank owner or operator needs to know about the fee change. Additionally, the letter explains the expansion of Fund Coverage and the scaled deductible the Division has implemented.  If you have any questions or require a more detailed explanation, please contact your local Environmental Field Office.

The Tennessee Department of Environment and Conservation encourages public participation throughout our processes towards our shared mission of protecting human health and the environment. The DRAFT forms and DRAFT SIM Chapters included on this webpage will have an announced public comment period after ALL DRAFTS are completed. We expect completion in the upcoming months.

However, if you would like to submit public comments before the Division of Underground Storage Tanks has completed all the DRAFTS, please email the Division to send your comments in a common format such as Microsoft Word or Adobe pdf, etc. Your comments will be reviewed and addressed after our formal public comment period has ended.

Notice of Rulemaking Hearing

The Underground Storage Tanks and Solid Waste Control Board is proposing two major changes to Chapter 0400-18-01. First, the current rules make fund coverage for a fund eligible release dependent upon an owner or operator's compliance history. With these revisions, all fund eligible will be entitled to reimbursement from the fund; however, an owner or operator's compliance history will now determine the amount of the fund deductible. Second, the revisions will suspend annual tank fees from July 1, 2021 through June 30, 2026. The amendments will also provide general cleanup revisions to Rules 0400-18-01-.09 and 0400-18-01-.10.  The Notice of Rulemaking Hearing and  the Redline version are below
